If, as an employee, I am denied employment because of my age, can I go to court to protect my rights?

The Constitution of Ukraine guarantees equal rights and freedoms of citizens. Among other things, this means that all persons should have equal access to work - regardless of age, gender, skin color, religious beliefs, etc. By refusing to hire a person because of his or her age, an employer violates the fundamental guarantees of protection of persons from discrimination, as defined in the Labor Code. If an advertisement for the search for employees contains a requirement regarding age, this is a violation of the Law "On Employment of the Population".

If you have been discriminated against on the basis of age, do not be shy about speaking up. Show your potential employer that you know the law and remind them that they are violating it. Ask them to give you a specific reason for the denial of employment. If you are sure that your age is the reason, try to record this answer. Politely warn your employer that you can sue them for discrimination.
