If I issue a power of attorney with a notary, will I be able to cancel it later through the Unified Register of Powers of Attorney if the notary who certified it is no longer working?
The procedure for canceling a power of attorney is determined by Chapter 4, Section II of the Procedure for Performing Notarial Actions by Notaries of Ukraine, approved by Order of the Ministry of Justice of Ukraine dated February 22, 2012 No. 296/5. According to the Procedure, the cancellation of a power of attorney is carried out by a notary or the head of the state notarial archive upon the application of the person who issued the power of attorney.
The notary or the head of the state notarial archive shall make a note on the copy of the power of attorney that is kept in the notary's files or archive, as well as in the register for registration of notarial acts, about the cancellation of the power of attorney or reassignment. An entry on the cancellation of the power of attorney or reassignment shall also be made on the copy of the power of attorney of the person who issued it, if such a copy is in his possession. In such a case, the copy with the note, together with the person's statement, shall be attached to the copy that is kept in the notary's files or archive.
