Draft law No. 7731 on amendments to the Labor Code regarding the establishment of an additional ground for terminating an employment contract at the initiative of the employer and some other issues is ready for the second reading.

In connection with cases of collaborationism, in particular, at critical infrastructure enterprises, the draft law proposes to give the employer the right to terminate the employment contract if:

  • the judgment of the court, by which the employee was convicted (except for exemption from serving a probationary sentence) for committing a crime against the foundations of national security of Ukraine, became legally binding;

  • the employee does not comply with the rules of conduct at the enterprise, institution, or organization.

Dismissal in such cases will require the prior consent of the primary trade union of which the employee is a member (according to Article 43 of the Labor Code).
