The donor has the right to terminate the gift contract only if the gift is in kind, that is, when the gift is preserved at the time of making such a claim. Preservation of a gift involves its being in the possession of the recipient in a condition that corresponds to its purpose. Therefore, the subject of the gift contract must be an individually determined, non-consumable item of appropriate value for the donor.
A donation contract cannot be terminated unilaterally, with some exceptions, in particular, Article 724 of the Civil Code of Ukraine provides that the donor has the right to refuse to transfer the gift in the future, if after the conclusion of the contract his property condition has significantly deteriorated, and the recipient has the right in any what is the time before accepting a gift on the basis of a gift contract with the obligation to give the gift in the future and to refuse it.
