In what cases can the court return a statement of claim?

In cases if:

1. Before the opening of the proceedings in the case, the plaintiff filed an application to return the claim to him

2. The application was submitted by an incapacitated person

3. The application on behalf of the Claimant was submitted by a person who does not have the authority to conduct the case

4. The case is not subject to the jurisdiction of this court

5. An application for divorce was filed during the wife’s pregnancy or before the child reaches one year of age without complying with the requirements established by the Family Code of Ukraine

6. The application was submitted without observing the procedure defined by the third part of Article 118 of the Civil Procedure Code of Ukraine
