I want to know whether the commander of a military unit is responsible for using subordinates to build his private house during the war, if he issued orders for them to perform combat missions in official documents?

If the police stopped a driver and accused him of drug use without sufficient grounds, and then took him to the CCC instead of a medical examination, can their actions be considered legal?
