Reduction of fine for the bank

If the bank did not provide the evidence requested by the court, but there was no repeated ruling on the re-request of the evidence, can the appellate court reduce the fine to the minimum amount in accordance with Part 1 of Article 148 of the Code of Civil Procedure of Ukraine?
