How can the High Qualification Commission of Judges recommend candidates for the positions of judges of the Lviv Appellate Court if one of the candidates received a break during the qualification assessment? Are there grounds to consider such a decision lawful?
If the High Qualification Commission of Judges of Ukraine has not confirmed the suitability of a judge for the position held, does the High Council of Justice have the right to cancel the decision of the HQCJ on submitting a petition for dismissal from the position held?
I am interested in whether the practice of regular evaluation of judges, which the HQCJ plans to introduce, contradicts the principles of judicial independence and whether it can affect the objectivity of judicial decisions? Is this evaluation considered legal from the point of view of Ukrainian legislation?
