I have heard many times about problems with the shortage of judges, especially when it is said that thousands of vacancies remain unfilled and the work of the courts is paralyzed. I am concerned about: what are the possible consequences of this staffing crisis for ordinary people who turn to the courts? Does the shortage of judges affect the time taken to hear cases, their quality, and generally my guaranteed right to judicial protection within the required timeframe?
I read that the new Criminal Code is planned to introduce liability for judges for making a knowingly illegal or unfounded decision. But I heard that there was a similar article before, which was later declared unconstitutional. I have a question: will there not be a risk of abuse again, when this norm is used to try to influence or pressure judges for every decision that is later overturned by a higher court? In such a situation, how will judicial independence and the rights of people who apply to the court be protected?
I am interested in whether the practice of regular evaluation of judges, which the HQCJ plans to introduce, contradicts the principles of judicial independence and whether it can affect the objectivity of judicial decisions? Is this evaluation considered legal from the point of view of Ukrainian legislation?
