Article 365. Exceeding power or official authority by a law enforcement officer

  1. Exceeding power or official powers, i.e. deliberate actions by an employee of a law enforcement agency, which clearly go beyond the limits of the rights or powers granted to him, if they caused significant damage to the rights protected by law, the interests of individual citizens, state or public interests, interests of legal entities, -

shall be punished by restriction of liberty for a term of up to five years or deprivation of liberty for a term of two to five years, with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.

  1. The actions provided for in the first part of this article, if they were accompanied by violence or the threat of violence, the use of weapons or special means, or actions that are painful and offend the personal dignity of the victim, in the absence of signs of torture, -

shall be punished by deprivation of liberty for a term of three to eight years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.

  1. Actions provided for by parts one or two of this article, if they caused serious consequences, -

shall be punished by deprivation of liberty for a term of seven to ten years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
