State responsibility for destroyed housing

I saw that the Supreme Court ruled that the state compensates for damage to destroyed housing only if a violation of its positive obligations is proven. How exactly can such a violation be proven, and who determines which specific obligations the state was supposed to fulfill in my situation if my house was destroyed during hostilities?
