How to avoid discrimination in new public procurement rules?
I see that in the new draft law on public procurement, contracting authorities will have more opportunities to apply subjective criteria, for example, through the evaluation of the so-called life cycle cost, and will even be able to choose more expensive suppliers. I am concerned whether this will lead to ordinary businesses being discriminated against in public procurement tenders, or whether preference will be given to 'their' companies under the guise of these new criteria? How can I challenge such a decision if I believe that I was unreasonably not chosen as the tender winner due to non-transparent evaluation approaches?
