Do I understand correctly that if a person is found guilty of fraud and the amount of damages incurred is greater than the standard fine for such an article, then the court must necessarily impose a fine that will not be less than this amount of damages? Are there exceptions when the fine may still be less than the amount of damages or does the court take into account any circumstances to reduce the fine?
