Acquittal in a case of illegal border crossing
I read that in Uzhhorod, the court acquitted a man accused of illegally transporting a person across the border during martial law, because a key witness refuted the charges, and the court deemed the prosecution's evidence inadmissible. If, for example, I am accused of the same offense, but the investigation cannot provide convincing evidence of my conspiracy or cooperation with other persons, can I be acquitted in the same way, or will there still be a risk of receiving punishment even in the absence of direct evidence?
