Responsibility for attempting illegal border crossing

I read the news about a man who was detained while trying to cross the border outside official checkpoints, and also helped others in doing so. I'm curious, if a person attempted to cross the border independently during martial law, what specific responsibility do they bear - would it be an administrative or already a criminal offense? And is there a difference in punishment between those who planned to flee alone and those who organize such 'assistance' for others?
