Legality of appointing department head as patient's guardian

I saw news that the Supreme Court questioned the appointment of the head of the psychosomatic department as a patient's guardian and annulled the corresponding resolution. I am interested in whether an employee of such a department can indeed become a patient's guardian and what general restrictions or specific provisions exist in legislation regarding this? What grounds could lead to a refusal of such an appointment?
