Fines for illegal felling of a Christmas tree

I read that illegal felling of a New Year's tree can result in a substantial fine, and in cases of significant damage, even criminal liability. I'm interested: if I find a fir tree in the forest that is already broken by the wind or lying on the ground, can I take it home without the risk of getting a fine or having legal problems? Do these rules only apply to cutting down live trees?
