Criminal liability for court decisions
I read that in the new draft Criminal Code, judges are proposed to be held criminally liable for making knowingly illegal or unfounded court decisions. However, I recall that a similar article was previously declared unconstitutional because it could be interpreted in many different ways, which opened the door to pressure on judges. Will this new norm not again become a tool for influencing judges and violating their independence? How is an ordinary person to understand whether a judge will truly be punished only for an intentionally illegal decision, and not for any judicial error?
