Can different delivery services be equated to one category?

I read that in New York, grocery delivery services such as Instacart are now subject to the same rules as food delivery, even though their operations are organized differently. I am interested in how fair it is for authorities to establish identical requirements for different categories of services, given that their organization and specifics differ, and whether companies can legally challenge such decisions at all?
