Can covert investigative actions be used without my presence?

I read that the Supreme Court ruled that if I was not present during the conduct of covert investigative actions, it does not violate criminal procedural law. But if evidence was obtained precisely when I was not present, can this evidence still be used against me in court? I am interested in whether this is truly legal, and do I have any protection in such a situation?
