Criminal liability of judges for arbitrary decisions
I read that the new Criminal Code is planned to introduce liability for judges for making a knowingly illegal or unfounded decision. But I heard that there was a similar article before, which was later declared unconstitutional. I have a question: will there not be a risk of abuse again, when this norm is used to try to influence or pressure judges for every decision that is later overturned by a higher court? In such a situation, how will judicial independence and the rights of people who apply to the court be protected?
