Liability for death on railway tracks

I read news about a case where a man died under the wheels of a train while crossing the tracks and failing to react to sound signals. I am wondering: in such a situation, is only the deceased person at fault, or can the train driver or the railway also be held liable? Does our legislation foresee any cases where railway employees can be held liable if the train had already applied emergency braking but could not stop in time?
