Fraud with a deceased person's pension

Unlawful receipt of pension payments causes their overpayment, losses to the state in the person of, in particular, the Main Department of the Pension Fund of Ukraine in the Kyiv region, which, as established by law, are subject to mandatory return. In addition, according to the assessment of law enforcement agencies, the actions of such persons contain signs of a crime provided for in Part 1 of Article 190 of the Criminal Code of Ukraine (CCU) (appropriation of another's property or acquisition of the right to property by deception or abuse of trust (fraud) - punishable by a fine or community service, or correctional labor, or probation supervision, or restriction of liberty), as well as Part 4 of Article 185 of the CCU (theft committed on a large scale or in conditions of martial law or a state of emergency - punishable by imprisonment for a term of five to eight years).
