Unrestricted Pension Restoration

Unfortunately, the maximum pension limit for military personnel is applied automatically, regardless of length of service, position, or service conditions. However, judicial practice holds a clear position: limiting a pension to the maximum amount is unlawful.

The procedure for removing the limitation:

1. A request to the Pension Fund demanding the calculations and the pension accrual protocol. This allows for the official recording and documentary confirmation of the limitation's application.
2. Submitting an application to the PFU for a pension recalculation. You state that you disagree with the limitation and request the calculation of the full amount in accordance with current legislation.
3. Receiving an official refusal. This is the basis for appealing to the court.
4. Filing a lawsuit in which you ask the court to oblige the Pension Fund to calculate and pay the pension for military personnel without the maximum size limitation.
