Late submission of a CCI certificate does not deprive a party of the right to invoke force majeure, unless the contract expressly provides that missing the deadline for submitting the certificate deprives of such a right. The courts distinguish between: * notification of force majeure must be timely, * the CCI certificate can be obtained and submitted later. Therefore, the delay in submitting the certificate is not, in itself, a ground for refusing to apply force majeure.
