Establishing the fact of the death of a serviceman

If a serviceman went missing during hostilities and there is no documentary evidence of his death, can I, as his relative, apply to the court with a statement to establish the fact of his death in order to receive such payments? I need reliable evidence, but will official investigation reports and eyewitness testimony be enough?
