Driver's responsibility

If a drunk driver causes a traffic accident that results in the death of a person, will he be held liable for this under Article 286 of the Criminal Code of Ukraine? Do the grounds for liability change if the driver was sober at the time of the accident, but later it turned out that he did not have the appropriate rights to drive a vehicle?
