Part 2 of Art. 28 of the Constitution of Ukraine, which states that no person can be subjected to medical, scientific or other experiments without his free consent. After all, a medical examination is carried out during the VLK, not experiments. In addition, Art. 43 of the Basic Law of Ukraine on health care, which stipulates the need to obtain the patient's consent for the use of diagnostic, preventive and treatment methods, cannot be taken into account as a reason for refusal either. After all, this norm is general along with the special norm of the Law of Ukraine "On Military Duty and Military Service", which fixes the obligation to undergo military training, which should be applied in this case.
However, the legislation does not prohibit a citizen from refusing a VLK, while at the same time establishing responsibility for such a refusal.
