The serviceman fell ill with covid, pneumonia. He was treated for 8 days. He was taken out of state. Is this legal?

This is not legal. Within 4 months, a serviceman has the right to be on medical treatment or on rehabilitation leave, if there are appropriate decisions of the Military Police. In such cases, there is no procedure for removal from the state at all.
