Pursuant to Article 403 of the Criminal Code of Ukraine, refusal to perform the commander's combat duties, committed in the absence of signs of disobedience, in a combat environment or under martial law, is punishable by service restriction for a term of up to two years or detention in a disciplinary battalion for a term of up to one year, or imprisonment for up to two years. The act provided for in the first part of this article, committed in the conditions of martial law or in a combat situation, is punishable by deprivation of liberty for a term of five to eight years.

*A mandatory feature of the objective side of the crime, provided for by Article 403 of the Criminal Code of Ukraine, is the occurrence of serious consequences due to failure to comply with the order.
