If you decide to register a TM, you should follow the following procedure:
Step 1. Submitting an application to Ukrpatent:
A special "form" is filled out (it can be found independently on the website of the Ministry of Economy), where the logo, a description of the logo, a list of goods and services for which the mark is submitted for registration, and contact details of the applicant are indicated;
An application fee is payable (its amount depends on the number of classes of goods and services for which the application is submitted).
Step 2. Formal examination, which involves checking the submitted documents and their content for compliance with the requirements of the law.
Step 3. Examination of the merits is the most important stage at which the decision to register the mark is made. Refusal of registration can be appealed in the appeal procedure.
Step 4. Obtaining a TM registration certificate.
If the expert did not see any problems with the logo, and a decision was made to register the mark, the applicant pays a registration fee and receives a certificate certifying ownership of the mark.
The term of trademark registration is about 1.5 - 2 years, which can be shortened to approximately 8-9 months, but the cost of such a service can be several times higher than the cost of trademark registration itself.
The certificate is valid for 10 years from the date of application, which can be extended an unlimited number of times.
