If the FOP is in arrears in paying taxes, it cannot be closed, because one of the stages of liquidation is a tax audit.

In order to liquidate a FOP that has unpaid obligations, the following actions must be performed:

  1. Submit to the state registrar at the place of registration a statement of termination of activity in the form of form No. 12, approved by order of the Ministry of Justice No. 3268/5 dated November 18, 2016. For this, you must have a passport with you;

  2. Apply to the tax service for verification of arrears of mandatory payments;

  3. If there is debt, repay it in full;

  4. Submit a liquidation report within 30 calendar days to the tax service;

  5. Submit an application for verification to the tax service at the place of registration;

Closing the FOP with debts is possible only by liquidating the debt due to mandatory payments. Failure to pay is subject to fines and penalties. The amount will be directly proportional to the number of days with unpaid tax.
