Can a collection company seize property for utility debts during martial law?
Collectors do not have the right to forcibly collect debts. However, they have the right to go to court to collect the debt assigned to them and, in the event of a positive court decision, to contact the enforcement service to collect the debt.
In accordance with the Law "On Enforcement Proceedings", the collection of housing and communal services debt should be suspended, but only in the following cases:
for housing and communal services in areas where hostilities are taking place,
for housing and communal services in areas that are or were under temporary occupation or encirclement (according to the approved list);
for housing and communal services in premises that are the permanent residence of a person and which were destroyed or damaged as a result of hostilities.
In all other cases, collection may occur.
