During martial law, a marriage can be dissolved through the state registry of civil status acts and through a court. In the event that the spouses have minor children, or one of the spouses objects to the dissolution of the marriage, the marriage may be dissolved exclusively by court order.
How to file for divorce at the Department of Social Security Administration?
A husband and wife personally come and submit a joint application to the RACS department at the place of residence - either jointly or one of them. Both should apply personally. However, if one of the spouses cannot come for a good reason - in connection with a serious illness, a long business trip, living in a remote area - it is allowed to submit an application by a representative by proxy.
Necessary documents:
Passports (if both come);
Passport, notarial application for divorce, power of attorney, application for divorce without the presence of one of the spouses (if someone comes alone).
Divorce by court
Divorce through court has 2 possible options:
"peaceful", in the order of a separate proceeding (such as a case of establishing a fact that has legal significance) - by submitting a joint statement of the spouses again;
"conflict" (litigation) - the way, of course, is less desirable. Occurs when the spouses cannot agree on certain issues - usually with whom the children/child will live, or in the presence of certain property claims. It is carried out through the submission of a lawsuit by one of the spouses to the court of first instance.
