She did not leave maternity leave, but took leave to care for a child under the age of six, in which she stayed for a year. At the moment, I want to cancel my vacation. The enterprise is not working at the moment, it will resume work only after the end of the war. Since I am a freelancer, my fixed-term contract will not be extended and I will be fired. Please tell me, can I expect any benefits in case of dismissal?

Yes, even if the enterprise is actually not operating, but not formally liquidated, the employee has the right to all payments provided for by law upon dismissal. According to the Labor Code of Ukraine (LCA), upon dismissal, the employee is entitled to: basic payments upon dismissal:

  1. Salary - for all time worked until the day of dismissal.

  2. Compensation for unused annual leave days.

  3. Severance pay, if the dismissal occurs at the initiative of the employer (for example, staff reduction, liquidation of the enterprise, etc.) - in the amount of not less than the average monthly earnings.
